Our offerings include policy evaluation, coverage gap analysis, and regulatory compliance guidance. We do not underwrite insurance policies or act as a broker; our role is strictly advisory. Clients receive written recommendations based on their specific operational risks and industry standards.
You agree to provide accurate and complete information about your business operations, assets, and risk exposure. Failure to disclose material facts may render our advice incomplete or unsuitable. You are responsible for implementing any recommended risk management measures and for reviewing all insurance policies with a licensed broker or insurer before binding coverage. NewJerseyCoverage is not liable for decisions made based on incomplete or outdated information provided by you.
To the fullest extent permitted by South African law, NewJerseyCoverage shall not be liable for any indirect, incidental, or consequential damages arising from the use of our advisory services, including but not limited to loss of business, claims denied by insurers, or regulatory penalties. Our total liability for any claim related to our services is capped at the fee paid for the specific engagement giving rise to the claim. This limitation does not apply in cases of gross negligence or willful misconduct.
We reserve the right to suspend or terminate access to our services if you violate these terms, provide false information, or engage in fraudulent activity. Upon termination, you must cease using any reports or recommendations provided by us. Sections on limitation of liability and governing law shall survive termination. You may cancel your engagement at any time by written notice, subject to payment for services rendered up to the cancellation date.
NewJerseyCoverage may update these terms from time to time to reflect changes in our services, legal requirements, or industry practices. We will notify you of material changes via email or a notice on our website at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the revised terms. If you do not agree, you may terminate the engagement without penalty within the notice period.
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved through mediation in Johannesburg before resorting to arbitration.
